Welcome to HI80S. These Terms of Service (“Terms”) govern your access to and use of the HI80S website, online store, social channels, and related services (collectively, the “Services”) operated by KURSD UNLMTD LLC, doing business as HI80S (“HI80S,” “we,” “us,” or “our”).

By accessing the Services or placing an order, you agree to these Terms and our Privacy Policy and Return & Refund Policy. If you do not agree, please do not use the Services.

1. Eligibility and Use

You must be at least 18 years old, or the age of legal majority where you live, to place an order through our store. You agree to use the Services only for lawful personal, non-commercial purposes.

You may not use the Services to interfere with their operation, attempt unauthorized access, introduce harmful code, misuse our content, or violate any applicable law.

2. Products and Availability

HI80S offers swimwear, resort wear, accessories, and related products. We make reasonable efforts to display product colors, details, sizes, and descriptions accurately. However, colors may appear differently depending on your screen or device, and minor variations may occur.

All products are subject to availability. We may limit quantities, discontinue products, correct errors, or update product information at any time without notice. We reserve the right to refuse or cancel an order when permitted by law, including due to suspected fraud, product availability, pricing errors, or inaccurate order information.

3. Pricing and Payments

All prices are shown in U.S. dollars, unless otherwise stated, and are subject to change without notice. Applicable taxes, shipping costs, and other disclosed charges will be calculated and shown before you submit payment.

By placing an order, you authorize HI80S and its payment processor to charge your selected payment method for the total order amount. You confirm that the payment information you provide is accurate and that you are authorized to use that payment method.

We work to ensure pricing accuracy; however, if an item is listed at an incorrect price, we may cancel the order and notify you. Any refund for a canceled order will be issued to the original payment method.

4. Orders and Shipping

An order confirmation does not mean that HI80S has accepted your order. Your order is accepted when we ship the item(s) or otherwise expressly confirm acceptance.

We aim to process and ship orders within the timeframe shown on the website or at checkout. If no shipping timeframe is stated, we will ship within a reasonable period consistent with applicable law. If a shipment is delayed, we will contact you with available options. Federal consumer-protection rules require online sellers to ship as promised, or, when no shipping time is promised, within 30 days unless the customer agrees to a delay.consumer.ftc

You are responsible for providing a complete and accurate shipping address. HI80S is not responsible for orders delayed, lost, or misdelivered because of inaccurate customer-provided address information. Risk of loss transfers to you when the order is delivered to the carrier, except where applicable law states otherwise.

For international orders, you are responsible for any applicable duties, taxes, customs fees, and import requirements unless expressly stated otherwise at checkout.

5. Returns, Refunds, and Cancellations

Returns, refunds, exchanges, and cancellations are governed by our Return & Refund Policy, which is incorporated into these Terms.

Because swimwear is hygiene-sensitive, returned items must be unworn, unwashed, with original tags, packaging, and protective hygiene liners attached and unaltered. Items marked final sale, customized items, gift cards, and items that do not meet our return conditions are not eligible for return except where required by law.

6. Intellectual Property

All content on the Services—including the HI80S name, logo, designs, product images, videos, graphics, text, packaging concepts, trademarks, and other brand materials—is owned by or licensed to HI80S and protected by applicable intellectual-property laws.

You may view and use the Services for personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify, sell, publish, create derivative works from, or otherwise exploit our content without prior written permission from HI80S.

7. Reviews and User Content

If you submit reviews, photos, videos, comments, tags, messages, or other content related to HI80S (“User Content”), you confirm that you own or have the necessary rights to share it.

You grant HI80S a non-exclusive, royalty-free, worldwide, transferable, sublicensable right to use, reproduce, modify, publish, display, and distribute that User Content for business, marketing, social media, and promotional purposes. We may credit you when reasonably practical, but are not required to do so.

Do not submit content that is unlawful, misleading, harmful, abusive, infringing, defamatory, or otherwise objectionable.

8. Third-Party Links and Platforms

Our Services may contain links to third-party websites, apps, payment providers, social platforms, or services. HI80S does not control and is not responsible for their content, privacy practices, products, or services. Your use of third-party services is subject to their own terms and policies.

9. Privacy

Your use of the Services is also subject to our Privacy Policy. We use third-party service providers, including Shopify and payment processors, to operate the store and process transactions. 10. Disclaimer of Warranties

To the fullest extent permitted by law, the Services and products are provided on an “as is” and “as available” basis. HI80S does not guarantee that the Services will be uninterrupted, error-free, secure, or free from harmful components.

Nothing in these Terms excludes warranties that cannot legally be excluded. Product-specific rights and remedies available under applicable law remain unaffected.

11. Limitation of Liability

To the fullest extent permitted by law, HI80S and its owners, employees, contractors, suppliers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Services or purchase of products.

To the fullest extent permitted by law, HI80S’s total liability for any claim related to an order will not exceed the amount you paid to HI80S for the product(s) giving rise to that claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless HI80S and its owners, employees, contractors, suppliers, and affiliates from claims, losses, liabilities, damages, costs, and expenses—including reasonable attorneys’ fees—arising out of your violation of these Terms, misuse of the Services, or violation of another person’s rights.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in Florida, unless applicable law requires another venue.
